VISA REFUSAL APPEALS AND JUDICIAL REVIEW

Receiving a refusal from the Home Office can feel discouraging. However, many refusals can be challenged or corrected.

The right approach depends on the reason for the refusal and the type of visa involved. We will review the decision carefully and advise you on your next steps promptly.

Applications are often refused because of:

  • Incorrect or missing documents
  • Financial evidence not meeting technical requirements
  • Insufficient proof of a genuine relationship
  • English language issues
  • Previous immigration history
  • Errors in the application form

Your options to challenge these decisions may include:

Appeal: In certain cases, you can formally appeal to the First Tier Tribunal, and if needed, to the Upper Tier Tribunal. This option is available for specific applications. Please contact us so we can understand your situation and determine if you qualify to appeal through this process.

Administrative Review: This option is available when the caseworker assessing your application has made a legal or factual error.

Judicial Review- Used when a decision is legally flawed or unfair. Where no appeal or review is available, or where previous remedies have failed, you do have the right to instruct us to pursue Judicial Review. This typically begins with a Pre-Action Protocol letter inviting the Home Office to withdraw or reconsider the decision before court proceedings are issued.

Fresh Application – In many cases, taking the time to address any issues and resubmitting your application is the most effective path forward. Previous attempts may have overlooked essential details or failed to comply with the required guidelines. By embracing this approach, you significantly increase your chances of success.

Time limits apply, so it is important to seek advice quickly.

Contact us on 0208 637 2127 or emailinfo@towngatesolicitors.co.uk if your application has been refused.
